Clarke County Be it Remembered, That in the terms of the law, in such cases made and provided, and before the honorable Court of Ordinary for the county of Clarke State aforesaid, Griffin Barber became the Executor of James Barber deceased. And in pursuance of said authority, in terms of the Law, in such cases made and provided, the said Griffin Barber Executor as aforesaid advertised for sale a certain tract or parcel of land to be sold on the first Tuesday of October eighteen hundred and fifty. And in compliance of which the said tract or parcel of land was exposed to at public out-cry on the day and year aforesaid, and Wayne Wise being the highest bidder, the said tract or parcel of land was knocked off to him at the price of Three Hundred and Fifty Dollars.

Now, Therefore, This Indenture, made this twenty sixth day of October eighteen hundred and fifty between Griffin Barber Executor on the estate of James Barber deceased, on the one part, and Wayne Wise on the other part. Witnesseth, that the Griffin Barber Executor as aforesaid for and in consideration of the sum of Three hundred and fifty dollars to in hand paid, at and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, hath granted, bargained, sold and conveyed, and by these presents do grant, bargain, sell and convey unto the said Wayne Wise his heirs and assigns, all that tract or parcel of land, situate, lying and being in the county and State aforesaid, on the waters of Calls Creek, containing sixty acres more or less, being the place whereon James Barber Deceased, resided at the time of his death, joining Lester, the land of Griffin Barber’s children, Cynthia Brewer, Patterson, & said Wayne Wise, reserving one fourth of an acre where the graves are for a burial ground for the relatives of said Deceased.

To have and to hold the said tract or parcel of land unto him the said Wayne Wise his heirs and assigns, together with all and singular the rights, members and appurtenances thereof to the same in any manner belonging to his and their own proper use, benefit and behoof forever in fee simple. And the said Griffin Barber Executor as aforesaid, in behalf of the estate of the said James Barber deceased, the heirs, executors, and administrators thereof, the said bargained premises unto the said Wayne Wise, his heirs and assigns, will warrant and forever defend the right and title thereof against themselves and against the claim of all other persons whatever. In witness whereof the said Griffin Barber Executor as aforesaid, hath hereunto set his hand and seal the day and year aforesaid.
