Samuel Thompson

Whereas SAMUEL H. THOMPSON late of Oconee County in said State departed this life on the 26th day of October in the year of our Lord one Thousand eight Hundred and Seventy nine (1879) making and uttering a nuncupative Will, the precise terms of which and the provisions thereof are not entirely agreed upon by the witnesses, and parties of interest. To the end therefore that Justice may be done to all the heirs at law and the wishes of the deceased complied with and his intention carried out.

This agreement made and entered into this 4th day of November Eighteen Hundred and Seventy nine (1879) between the heirs at law as aforesaid to wit-- LUCIOUS FEW and his wife, FANNIE H. FEW, and A. J. ROYSTON and his wife LUCY A. ROYSTON, each of the county of Morgan and State aforesaid. E. F. BOND and his wife EMMA C. BOND of the county of Franklin and State aforesaid, WILLIAM H. THOMPSON, Mrs. MARY J. EBLISO, Misses MARTHA T. THOMPSON and IDA O. THOMPSON and Mrs. REBECCA A. THOMPSON wife of deceased, these last five all of the county of Oconee and State aforesaid.

Witnesseth -That it is agreed by and between the above name parties that WILLIAM H. THOMPSON in accordance with the wishes of deceased shall have use and enjoy absolutely and in fee simple forever all that part and portion of land lying North of the road leading through the lands of deceased, said road being the line on the South. Bounded on the West by BRICE H. BISHOP and WM. H THRASHER bounded on the East by Dr. J. T. HESTER and RICHARD THOMPSON and on the North by WILLIAM H. THRASHER.

It is understood and agreed by and between the parties that the said WILLIAM H. THOMPSON is to remain on the premises of deceased to manage for and take care of his mother, wife of deceased during her natural life.

The said REBECCA A. THOMPSON wife of deceased with the three girls MARTHA T. THOMSPON, IDA O. THOMPSON and MRS. MARY J. EBLISO to have use and enjoy all the estate real, personal and mixed during her natural life. The said REBECCA A THOMPSON and at her death to be equally divided between all the children including the said WILLIAM H. THOMPSON share and share alike.

To the above agreement the parties hereto jointly and severally bind themselves, their heirs, executors and administrators the same to be conclusive of the claims of all and each of the contracting parties. In Witness Whereof the parties hereto have hereunto set their hand and affixed their Seals in confirmation of this agreement.
